Dance Kudos — Terms of Use

1. Acceptance

By downloading or using Dance Kudos (the "App") you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App. These Terms are between you and Andrey Karakotov, the service provider operating Dance Kudos ("we", "us", "Dance Kudos"). Apple is not a party to these Terms.

2. Eligibility

You must be at least 16 years old to use the App. By uploading a video you confirm you are 16+, that you have the right to upload it, and that you have the necessary consent of any identifiable people shown in it (including dance partners and bystanders). Do not upload videos of minors without the rights and consent to do so.

3. What the App does

The App analyzes a practice video you choose and returns AI-generated compliments highlighting things you appear to do well, tied to timecodes and clips. The feedback is automated, may be incomplete or inaccurate, and is for encouragement and entertainment. It is not professional dance coaching, medical, physiotherapy, or fitness advice, and must not be relied on as such. Dance within your own physical limits.

4. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by the Apple Media Services Terms and the standard Apple licensed application end-user license agreement (EULA), which applies in addition to these Terms. You may not copy, reverse engineer, resell, or abuse the App or its API, or use it to build a competing service.

5. Your content

You keep ownership of the videos you upload and the compliments you receive. You grant us a limited license to process your video solely to provide the analysis and to operate and improve the service as described in the Privacy Policy. Uploaded videos are stored so you can review them, collect compliments on them, and share them with people you choose; they remain until you delete them (per-video, or everything via Settings → Delete account). You are responsible for the content you upload and for having the rights and consents to upload it.

6. Acceptable use

Do not use the App to upload unlawful content, content you have no right to, content depicting minors inappropriately, or to harass, infringe, or violate others' privacy or rights. We may suspend or terminate access for violations.

6a. Peer features & community

The App lets you exchange messages with other users — compliments on practice videos, sent to people you invite (directly or via a group link) or, if both sides opt in, through the community. These rules apply:

• Compliments only. The App is a positive-only space: messages are limited to noticing what is working. Every message passes an automated check before delivery; corrective, negative, or comparative content is rejected and is not delivered.
• Report and block. You can report any message you receive and block a sender; blocking is silent. Repeated safety reports suspend a sender's community access.
• Community is double opt-in. Your practices are shown to other community members only if you opted in and marked them community-visible; you can leave at any time.
• Invite links expire within 24 hours and can be revoked in the App. Share them only with people you actually want in your group.
• When you send a compliment, you grant us the license needed to deliver and store it for its recipient (it lives in their journal). Recipients can delete what they received; deleting a video also deletes the compliments attached to it.

7. Free use and Dance Kudos Premium

The App is free to use with a monthly allowance of fresh-video analyses (revisiting an already-analyzed video with another lens is free). Exact numbers are shown in the App and may change.

Dance Kudos Premium is an auto-renewable subscription offered on a monthly or annual basis. There is no free trial.

• The price and billing period are shown in the App before you confirm a purchase and may vary by region.
• Payment is charged to your Apple Account at confirmation of purchase.
• The subscription renews automatically for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your Apple Account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription in your App Store account settings after purchase. Deleting the App does not cancel a subscription.
• "Restore Purchases" is available on the paywall.
• Refunds are handled by Apple under the Apple Media Services Terms; except where required by law, payments are non-refundable and there is no refund for partial periods.

Premium currently unlocks unlimited analyses and premium share templates. Benefits may evolve. Purchases and entitlements are processed via RevenueCat and the Apple App Store.

8. Third-party services

The App relies on Google (Gemini models, Google Cloud, Firebase), RevenueCat, and Apple. Your use of the App is also subject to their applicable terms. We are not responsible for third-party services.

9. Intellectual property

The App, its design, and its content (excluding your videos and the compliments generated for you) are owned by us and protected by law.

10. Disclaimers & limitation of liability

The App is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the analysis is accurate, complete, or uninterrupted. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for any loss arising from your use of the App; our total liability is limited to the amount you paid us in the 12 months before the claim. As required by Apple, Apple's maximum liability for the App is the amount (if any) you paid for it.

11. Termination & data deletion

You can stop using the App at any time and delete your account and data in-app (Settings → Delete account), which cascades as described in the Privacy Policy. We may suspend or end access for violations of these Terms.

12. Changes

We may update these Terms; material changes will be reflected by the "Last updated" date and, where appropriate, in-app notice. Continued use after changes means you accept them.

13. Governing law & contact

Nothing here removes mandatory consumer rights you have under local law. Questions: info@dancekudos.app.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
